PHOTOGRAPHY AGREEMENT

By booking a session with Sofiia Rybak, the Client acknowledges and agrees to the following terms and conditions:
1. APPLICABILITY OF TERMS
These terms and conditions apply to all bookings, regardless of where the session is reserved — whether through the official website, Instagram direct messages, email, or any other communication platform.
By booking a session and/or submitting a deposit, the Client confirms that they have read, understood, and agreed to these terms in full.
2. PAYMENT AND BOOKING
To secure your session date, a non-refundable retainer of 50% of the total session fee is required at the time of booking.
The remaining balance is due on the day of the session before the photoshoot begins.
Failure to pay the retainer will result in loss of the reserved date.
3. COMMUNICATION AND CONDUCT
The Client agrees to maintain respectful and professional communication with the Photographer at all times, including via email, text, or social media.
Any form of rude, aggressive, or inappropriate language will result in termination of services without refund.
4. CHILD BEHAVIOR AND COOPERATION
The Photographer is not responsible for uncooperative behavior, emotional distress, or lack of participation from children or other participants during the session.
While every effort will be made to engage and capture genuine expressions, the final results depend on the cooperation of all subjects.
No refunds, reshoots, or partial credits will be provided due to uncooperative behavior.
Parents and guardians are responsible for managing their children’s conduct throughout the session.
5. OUTDOOR CONDITIONS AND ENVIRONMENT
Outdoor sessions may involve natural elements such as insects, uneven terrain, weather changes, or other environmental factors beyond the Photographer’s control.
The Photographer is not liable for discomfort, bites, or allergic reactions that may occur during or after the session.
Clients acknowledge these conditions and agree to take necessary precautions (such as insect repellent, appropriate clothing, or footwear) when participating in outdoor sessions.
6. ARTISTIC STYLE AND CREATIVE JUDGMENT
The Client acknowledges that they have reviewed the Photographer’s portfolio and are familiar with Sofiia Rybak’s style.
The Photographer’s artistic vision is constantly evolving, and images may vary from session to session.
The Photographer will use her professional judgment to select the best images and edit them in her signature style.
Artistic interpretation is subjective, and no specific image, pose, or editing style is guaranteed.
No refunds or reshoots will be provided based on aesthetic preferences.
7. NO REFUNDS OR RESHOOTS FOR SUBJECTIVE DISSATISFACTION
Once the session has taken place and the images have been delivered according to this agreement, the Photographer’s obligations are fulfilled.
No refunds or reshoots will be issued due to client dissatisfaction with appearance, posing, or personal taste.
8. PHOTOGRAPHER’S JUDGMENT IS FINAL
The selection and editing of images are made at the Photographer’s discretion.
Unedited RAW files will not be released under any circumstances.
9. LATE ARRIVAL / MISSED SESSION
Sessions begin and end at the scheduled time.
If the Client arrives late, the session time will not be extended.
No refunds or reshoots will be provided for missed time.
If the Client is more than 15 minutes late without notice, the session may be considered canceled with no refund.
10. PHOTOGRAPHER’S RIGHT TO REFUSE SERVICE
The Photographer reserves the right to refuse service to anyone whose behavior, communication, or requests are deemed unreasonable, unsafe, or disrespectful.
11. USE OF IMES FOR ADVERTISING & PROMOTION
The Client acknowledges that the Photographer has the right to use their images in advertising, exhibitions, and marketing purposes both online and offline, including but not limited to social media, websites, blogs, and printed materials.

The Client grants the Photographer permission to use their images for these purposes unless otherwise agreed in writing.
12. DISPUTE RESOLUTION
Any disputes or claims arising from this Agreement shall first be attempted to be resolved through private mediation before any legal action is taken.
13. AGREEMENT ACCEPTANCE
By proceeding with the booking and/or paying the retainer, the Client confirms that they have read, understood, and agreed to all terms of this Agreement.
The Client consents to image processing and editing at the Photographer’s discretion and agrees not to alter, edit, or manipulate the delivered images in any way.
